Açık Radyo’nun karasal yayını 16 Ekim 2024 Perşembe saat 13:00 itibariyle kesildi.
Açık Radyo 29 yıl 11 aydır FM bandında, ayrıca 22 yıl 11 aydır da internet üzerinden Türkiye’ye ve dünyaya yayın yaptı. Bu niteliğiyle, eşine dünyada da ender rastlanan köklü bir kurumdur.
RTÜK’ün basın özgürlüğünü çiğneyerek verdiği lisans iptali kararından tam bir gün sonra İzmir Basın Kampı'nda Basın Özgürlüğü Ödülü’ne layık görülen ve böylelikle 29 yılda ulusal ve uluslararası alanda 69’uncu ödülünü alan Açık Radyo, bugüne dek, tamamı gönüllü 1.416 programcısıyla 1.219 farklı program üretti, ve bu programlardan türetilen 29 kitap yayınladı. Her yıl bir kitap! 30 yıl boyunca Türkiye’den ve dünyadan yaklaşık 26 bin aktivist, yazar, düşünür güzide konuk ağırlandı.
Açık Radyo Kamusal Parklar, Ormanlar Gibi Bir Müşterektir
Açık Radyo dendiğinde akla, bir başka mecrada hakettiğini bulamamış bir hüzünlü şarkı; radyo tiyatrosundan aklınıza kazınan müthiş bir tirad; edebiyatın görünür kıldığı bir büyük hikâye; insanlığın renk ve titreşimlerini sesle çepeçevre kuşatan bir mecra gelir.
Açık Radyo dendiğinde akla, milyonlarca insanın Londra’da başlatıp Ankara’da devam ettirdiği bir barış çığlığı; Yırca’da, Cerattepe’de, Akbelen’de ağaçlarına var güçleriyle sarılarak sahip çıkan köylü kadınlar ya da lise önlerinden meydanlara taşarak, fosil yakıt şirketlerinin boyunduruğunda canlılar âlemini yokoluşa sürükleyen resmî iklim politikalarını protesto eden gençler gelir.
Açık Radyo dendiğinde akla, ekoloji mücadelesinin, sosyal dayanışmanın, hak mücadelelerinin seslerine daima kürsü ve megafon olan sakin ama kararlı bir radyo istasyonu gelir.
Açık Radyo Kamusal Faydanın Sesidir
Açık Radyo’nun sesi kamusal faydanın sesidir. Açık Radyo kurulduğu günden bu yana herhangi bir kişi ya da grubun çıkarını gözetmeksizin “kamu yararına” yayın yapmıştır.
Gücünü ve dirayetini buradan alır. Açık Radyo Türkiye ve dünya kamuoyunda, gerek siyasette gerekse kültür, sanat ve edebiyat alanlarında ne tartışılıyorsa bunu itidal ve sağduyu ile ve fakat eksiksiz konuşmayı kendine görev bilir.
RTÜK kararıyla Açık Radyo’nun “karasal yayın lisansının” iptal edilmesi hangi teknik ya da bürokratik gerekçeye dayandırılıyor olursa olsun, kesinlikle kamunun sesini kısma girişimidir. Tarihe öyle geçecek ve daima öyle hatırlanacaktır.
Şimdi Ne Olacak?
Açık Radyo’nun karasal yayın lisansının iptaliyle birlikte, FM yayına bağlı sürdürülen eş zamanlı internet yayını da sona erdi. Ancak karasal yayın lisansının iptali, radyonun kapanması anlamına gelmiyor. Radyonun yayıncı olarak başvurma hakkı olan farklı lisans biçimleri mevcut ve bunlardan biri ile yayının sürdürülmesi planlanıyor. Ayrıca karara karşı yürütmenin durdurulması istemli dava açılmış olup, hukuki süreçler halen devam etmektedir.

Toplumumuz giderek sayıları artan şiddet sarmallarıyla dörtbir yandan kuşatılmışken birbirimizi dinlemek, ortak bir gelecek hayal edip onu hep birlikte kurmaktan başka çaremiz yok.

Açık Radyo’s Terrestrial (FM) Broadcast Shut Down by the Turkish Radio and Television Supreme Council Açık Radyo’s terrestrial broadcast (FM) license has been officially canceled by the Turkish Radio and Television Supreme Council. The radio went off air officially on October 16, 2024 at 1 pm. Açık Radyo, the longest-running community radio in Turkey, has broadcast on the FM frequency for 29 years and 11 months, and on the internet for 22 years and 11 months, to both Turkey and the world. With its 30th broadcasting anniversary only a month away, this news has been the latest blow to freedom of speech and media in Turkey.
Known for its motto, "a radio open to all the sounds, colors, and vibrations of the universe," Açık Radyo has been a pillar of freedom of thought and speech in Turkey, prioritizing the principles of universal journalism in its thousands of programs, both in the field of news reporting and in many other fields such as law, philosophy, history, anthropology, science, culture, literature and art.
Açık Radyo received its 69th award in total a day after the license cancellation decision of the Turkish Radio and Television Supreme Council was served, and to date, has produced 1219 different programs with 1416 hosts, all of whom were volunteers, and 29 books inspired by these programs have been published.
Why the cancellation?
Turkish Higher Council for Radio and Television’s decision was delivered to Açık Radyo, on October 11, 2024, following the legal process that started in late May. In the original decision dated 22.05.2024, Açık Radyo was sentenced to an administrative fine and a five-day suspension of the broadcast of the program, Açık Gazete, for violating the principle in Article 8, paragraph 1, subparagraph b) of Law No. 6112 on the Establishment and Broadcasting Services of Radio and Television Enterprises and Broadcasting Services, which states that broadcasting services "cannot incite the public to hatred and hostility or create feelings of hatred in society by making distinctions based on race, language, religion, gender, class, region, and religious order.
The reason given for the above-mentioned decision was based on the statements in the broadcast of the 'Açık Gazete' program on April 24, 2024. According to the statement in the decision; “... The guest of the radio program stated: ‘The 109th anniversary, the anniversary of the massacres of Armenians, that is, the deportations and massacres that took place in the Ottoman lands, the massacres that are termed genocide. This year the commemoration of the Armenian genocide was also banned, you know.’...The fact that the programmers did not attempt to correct the statements made by the guest is found to be incompatible with the understanding of public responsibility and responsible broadcasting, as well as an incitement to hatred and hostility, and creating feelings of hatred in society.”
A clear attack on freedom of thought and speech
This specific interpretation of the law clearly violated the principles of freedom of thought and speech that have been an integral part of the broadcasting policy adopted and employed by Açık Radyo. Ömer Madra, the editor-in-chief of Açık Radyo, emphasized that “as a radio open to all the sounds, colors and vibrations of the universe, in this context, it is extremely incomprehensible and upsetting for us that our radio station is even alleged to have violated an article of the law stating that ‘It cannot incite the society to hatred and hostility or create feelings of hatred in the society by making distinctions based on race, language, religion, gender, class, region, and religious order.’ As we have tried to express during the judicial process, from the moment it first went on air, Açık Radyo has always defended freedom of thought and expression and, as a natural consequence of this, freedom of the press. Freedom of thought and expression, and by extension, freedom of the press and freedom of the public to have access to information, are regulated in detail both in international conventions to which Turkey is a party and, in our Constitution, and there are countless international and national judicial decisions to guide practice in this regard. Moreover, freedom of expression is one of the fundamental foundations of a democratic society and a sine qua non of pluralism, tolerance, and open-mindedness.”
What next?
Açık Radyo announced that they will apply through legal means against both the ruling to reject the request for a stay of execution and the decision for the cancellation of their broadcast license and that their legal struggle will continue. They are also considering several alternative options to continue their broadcast over the internet. Meanwhile, they have invited all their listeners, professional organizations, and the international public to raise an even clearer and louder voice for Açık Radyo, and against this decision that will result in irreparable loss for press freedom in Turkey.
